These Terms of Use (“Terms”) govern your use of internet.pesdish.com (the “Site”), operated by Planet Earth Satellite, Inc., doing business as Planet Earth Satellite (“we”, “us”, “our”). By using the Site or submitting the inquiry form, you agree to these Terms. If you do not agree, please do not use the Site.
What this Site is. Planet Earth Satellite is not an internet service provider. We are an independent service that helps consumers understand which options from participating third-party providers may be available at their address. We do not own or operate a network, we do not represent all providers, and we cannot guarantee that any particular provider, plan, price, or speed is available to you.
1. What we do and don’t promise
- We help you explore services offered by participating third-party providers. We do not provide internet service directly.
- Availability, providers, plans, prices, speeds, equipment, promotions, installation requirements, credit requirements, taxes, fees, and terms are set by the providers and vary by address. They can change without notice.
- Nothing on the Site is an offer, a quote, or a guarantee of service, pricing, or availability. Any figures discussed become binding only in an agreement you sign directly with a provider.
- Submitting the form does not create an order for service and does not reserve anything.
- We do not guarantee that a specialist will find an option that suits you, or that any option will be available at your address at all.
2. Using the Site
You agree that you will:
- Provide accurate information, and only submit a phone number and service address that you are authorized to provide.
- Use the Site only for lawful purposes and only to inquire about service for yourself or for someone who has asked you to do so.
You agree that you will not:
- Submit false, automated, or bulk inquiries, or otherwise interfere with the form.
- Attempt to gain unauthorized access to the Site, its servers, or any related systems.
- Scrape, copy, or reuse the Site’s content or code except as permitted by law.
- Use the Site in a way that damages, disables, or overburdens it.
We may refuse service, remove content, or block access if we reasonably believe these Terms have been breached.
3. Contact permission
If you check the consent box and submit the form, you authorize Planet Earth Satellite, Inc. d/b/a Planet Earth Satellite to contact you at the phone number you provided, including by telephone call and text message, about internet service options. Consent is not a condition of any purchase. Message frequency varies and message and data rates may apply. Reply STOP to opt out of texts, or contact us at any time to ask us to stop calling. 4. Third-party providers and links
Any service you ultimately purchase is provided by a third-party provider under that provider’s own agreement with you. We are not a party to that agreement and are not responsible for a provider’s services, pricing, billing, equipment, installation, outages, customer service, or privacy practices. Provider names and trademarks belong to their respective owners, and any reference to them does not imply endorsement or affiliation beyond any participating-provider relationship we actually have.
5. Intellectual property
The Site, including its text, layout, graphics, and code, is owned by Planet Earth Satellite, Inc. or its licensors and is protected by copyright and other laws. You may view and print pages for your own personal, non-commercial use. You may not otherwise reproduce, distribute, modify, or create derivative works from the Site without our written permission.
6. Disclaimer of warranties
The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete, accurate, or current.
7. Limitation of liability
To the fullest extent permitted by law, Planet Earth Satellite, Inc., its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your use of the Site — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability arising out of or related to the Site will not exceed one hundred US dollars (US$100.00).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. Indemnification
You agree to indemnify and hold harmless Planet Earth Satellite, Inc. and its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your submission of information you were not authorized to provide.
9. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
10. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and we will update the effective date above. Your continued use of the Site after a change means you accept the updated Terms.
11. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site.
